Oriental Trade disclaims any warranty or merchantability or fitness for a particular purpose.
Oriental Trade expects that its subscribers who provide Internet services to others will comply fully with all applicable laws concerning the privacy of online communications. A subscriber's failure to comply with those laws will violate Oriental Trade policy. If Oriental Trade is sued because of activities of the subscriber that violate any law or the Services Agreement, the subscriber will pay any damages awarded against Oriental Trade, plus costs and reasonable attorneys' fees.
If your domain name is going to expire soon, please renew it before the expiry date. Domain name renewal will only be processed upon receiving of your payment. Please note that expired domain names will be deleted by the registrars without prior notice. Oriental Trade will not be liable for any loss or damage resulting from the domain name deletion.
UpdateWeb King service and website marketing system will only be continued upon receiving of your monthly payment. Oriental Trade will not be liable for any loss or damage resulting from termination. Oriental Trade is the proprietor of all copyright and all intellectual property rights of the UpdateWeb King modules development, website marketing system and related design.
The Customer acknowledges that the service and its application cannot be cancelled upon signing of this contract.
Both parties agree that they shall further be bounded by the terms and conditions specified in www.orientaltrade.net and www.e-bo.com.hk . Oriental Trade reserves the right to change this Terms and Conditions any time, so please, check this page frequently or when in doubt.
The Customer warrants to Oriental Trade that the content of the Customer’s website does not contain any illegal materials, nor contains any content that may infringe the copyright of any third party.
Oriental Trade shall not be held liable for any loss, damage or claim arising from launching the website on a specified date or at all for whatsoever cause, nor will it be held responsible for any error contained in the launched website.
The Customer shall indemnify, defend and hold harmless Oriental Trade from and against any or all charges, costs (on a full indemnity basis) including but not limited to all reasonable legal fee incurred, loss or damages arising from any legal actions or threatened legal actions, claims or disputes for launching the website in accordance with the instruction, material, document or information given to Oriental Trade by the Customer.
Any scripts, cgi applications, php scripts, or software written by Oriental Trade remain the copyright of Oriental Trade and may only be commercially reproduced or resold with the permission of Oriental Trade. Oriental Trade reserves the right to cancel the contract with customer without any reasons with immediate effect, with no compensation.
Oriental Trade will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material.
Oriental Trade cannot take responsibility for any losses incurred by the use of any software created for the client. Whilst every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all software is functioning correctly before use.
Any scripts, cgi applications or software (unless specifically agreed) written by Oriental Trade remain the copyright of Oriental Trade and may only be commercially reproduced or resold with the permission of Oriental Trade.
Where applications or sites are developed on servers not recommended by Oriental Trade, the client is expected to provide or seek any information,additional software,support or co-operation pertaining to the server required in order for the application to be correctly developed. Where large applications are to be developed, it is the clients responsibility to provide a suitable testing environment which is identical to the final production environment.
The client is expected to test fully any application or programming relating to a site developed by Oriental Trade before being made generally available for use. Where "bugs", errors or other issues are found after the site is live, Oriental Trade will endeavor (but is not obliged to) to correct these issues to meet the standards of function outlined in the brief.
Deposit and payment is non-refundable and non- transferable.
For web design service, it is 50% prepayment in advance and the ending balance will be collected after the task is completed and before launching. For web hosting service, it is 100% prepayment in advance.
